Home Office guidance: National security determinations that allow retention of biometric data 

This guidance is to provide direction to any police force in England and Wales, the Police Service of Scotland, the Police Service of Northern Ireland and to any other law enforcement authority about the making or renewing of a national security determination (“NSD”) allowing the retention and use of biometric material for national security purposes.

This guidance is admissible as evidence in criminal and civil proceedings. If any provision of this guidance appears relevant to any court or tribunal considering any such proceedings, it may take that into account. In addition, the Commissioner for the Retention and Use of Biometric Material (“the Biometrics Commissioner”) 1 may take the provisions of this guidance into account when exercising his or her review functions under the 2012 Act.
