Women and Equalities Committee report: The use of non-disclosure agreements in discrimination cases inquiry

“The Government must reset the parameters around the use of non-disclosure agreements (NDAs) and address the failure of the employment tribunal system to ensure all employees who have experienced discrimination have a meaningful route of redress”.

Following the inquiry into sexual harassment in the workplace, the Women and Equalities Committee have published a June report 2019 on the use of non-disclosure agreements.

The report recommends:

  • The Government should begin an awareness-raising programme for employers and employees about how to handle grievances fairly and effectively, including signposting to relevant guidance and support.
  • The Government should commission an equalities review of the employment tribunal system and report publicly on its findings.
  • The Government must urgently improve the remedies that can be awarded by employment tribunals as well as the costs regime to reduce disincentives to taking a case forward.
