The local authority applied for judicial review of a decision of the secretary of state to reduce the amount of funding for childcare, quality and access projects that could be carried forward into the following financial year.

Outcome
The secretary of state had not fulfilled his race and disability equality duties as he had failed to consider the impact of his decision to reduce the amount of annual funding for childcare, quality and access projects, concerning the building of schools and nurseries that could be carried forward into the following financial year. The decision should be quashed and re-made having had due regard to the equality duties.
