Summary of case
Two severely disabled adults challenged the Council’s decision to change eligibility rules for adult social care.

Outcome
The Court concluded that ‘the Council did not conduct the rigorous analysis and consideration required in order to satisfy the ‘due regard’ duty under s.49A DDA 1995, principally because it did not gather the information required to do so properly.’
